6. Intellectual Property and User Content

AI-Generated Content Disclaimer

Our services may use artificial intelligence to generate workout, recovery, or nutrition recommendations. These outputs are algorithmically generated and not human-verified. You acknowledge that results may be inaccurate or incomplete, and you should always use your own judgment and consult a healthcare professional before acting on any recommendation.

App Updates and Changes

• Continued use of the app constitutes acceptance of updates

9. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability is limited to the amount you paid for premium features in the 12 months prior to the claim
• For free features, our liability is limited to $100 USD
• We are not liable for indirect, incidental, or consequential damages

10. Account Termination

12. Dispute Resolution

Governing Law

These terms are governed by and construed under the laws of the State of Florida, U.S.A., without regard to its conflict-of-law principles.

Informal Resolution

Before filing any formal dispute, you agree to contact us at legal@maplerune.com and attempt to resolve the issue informally for at least 30 days.

Binding Arbitration

If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or our services will be resolved by binding arbitration on an individual basis, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association's rules and procedures. The arbitration will take place in Florida, unless you and we agree otherwise. The arbitrator's decision will be final and binding.

Class Action Waiver

YOU AND MAPLERUNE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Maplerune LLC agree, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

Exceptions to Arbitration

Either party may seek equitable relief in court for infringement or misuse of intellectual property rights (such as trademarks, trade dress, domain names, trade secrets, copyrights, or patents).

13. Data Export and Portability

We believe you should have control over your data:

• Export your workout history and progress data
• Download your custom workout templates
• Request data deletion upon account closure

Data Format

• Data exports will be provided in standard formats (JSON, CSV)
• Exports include your personal data but not our proprietary algorithms
• Progress photos are exported as image files

15. Changes to Terms

We reserve the right to modify these terms at any time. Updated terms will be posted on our website with a new "Last updated" date. Your continued use of our services constitutes acceptance of the modified terms.

16. Indemnification

You agree to indemnify, defend, and hold harmless Maplerune LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with:

• Your access to or use of our services
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any injuries or health issues arising from your use of Wora or following workout recommendations
• Any content you submit or share through our services

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of these claims.

17. Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent. Any attempted transfer or assignment in violation of this section will be null and void.

18. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on our services, constitute the entire agreement between you and Maplerune LLC concerning our services. These Terms supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral, regarding our services.

20. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

21. California Residents

If you are a California resident, you may have these Terms mailed to you electronically by sending a letter to the address listed in the Contact Information section with your email address and a request for these Terms.
